Historical Background (last updated March 2011)

The Copyright Act is in the process of being amended; the UBC Access Copyright agreement that provides for coursepacks and other copying not permitted under the Copyright Act is set to expire on December 31, 2010; and, individuals are increasingly relying on electronic resources.

It is clear that the upcoming changes in Access Copyright arrangements will have very serious financial impact on the university.  The University is actively considering a range of options to mitigate the financial burden while ensuring a transition to new practices that is as painless as possible for students and faculty.  While the University is doing this, faculty and students are not being asked to take any special measures and they may proceed as if previous Access Copyright arrangements remain in place.  See the attached backgrounder, which outlines UBC’s position, as well as the Proposed Access Copyright Tariff for more information.

The Copying and Scanning at UBC guide, and other links to the right, should answer many of your questions.   In addition, the Association of Universities and Colleges of Canada (AUCC) recommends adoption, effective January 1, 2011, of the Fair Dealing Policy, which was prepared by legal counsel for AUCC, along with an FAQ on the Fair Dealing Policy.
